The lawsuit was filed by Lynnette D. C., a woman from New York who was implanted with the Option™ ELITE Retrievable Inferior Vena Cava Filter (“IVC Filter”) manufactured by Argon Medical Devices Inc. and Rex Medical, L.P.
The IVC Filter was implanted in her vein to catch blood clots and prevent a pulmonary embolism on March 11, 2015 at Montefiore Einstein Division Hospital in Bronx, New York by Dr. Jonathan Trambert.
She underwent an unsuccessful attempt at retrieving the IVC Filter on April 21, 2016 at Montefiore Weiler Periop Hospital by Dr. Isaam Koleilat. The IVC Filter was not retrieved.
She is seeking compensation for injuries related to her IVC Filter tilting, becoming embedded in her vein, and remaining implanted in her body because it is unable to be removed.
Rex Medical and Argon Medical Devices are accused of negligence for selling a defective medical device and failing to warn about risks.
The lawsuit was filed on June 27, 2018 in the First Judicial District of Pennsylvania — Philadelphia Court of Common Pleas (Trial Division / Civil Section) — Case ID: 180603387.
